An example of a case the Community Law Service Court Worker may deal with:

Mr A was due before court for a possession of a mortgaged property. Owing to a road accident to which the client was involved in, his case was heard in his absence and he was evicted from the property.  He attended the County Court Money Advice Office and an application was made to suspend the warrant of eviction.  Mr A did not present his application prior to the bailiff attending the property and he was subsequently evicted.  Once a client is evicted from the property, the court is unable to assist the client further.  The advisor responsible for the case made an application to appeal the eviction and the matter was heard before a circuit judge. In light of the limited assistance the court could give the client the case was adjourned to allow Leicester Money Advice an opportunity to put forward a skeleton argument on why in this instance the decision to evict was incorrect.  The client was forced to move in with his parents during the adjourned period. A skeleton argument was prepared for the Circuit Judge and 14 days letter the application was accepted and the eviction removed.  The client was allowed to regain access to his property and has now discharged all his outstanding mortgage arrears.
